Hogan Thompson Secures Near-Total Win for Moody National Companies
Hogan Thompson partners Chris Hogan and James Schuelke secured a near-total win for their clients in a recent high-stakes arbitration proceeding. Along with Harris Wells of Reynolds Frizzell, Chris and James represented affiliates of the Moody National Companies, a commercial real estate firm in Houston, Texas. Claimants in the arbitration sought more than $37 million against fifteen defendants and also sought exemplary damages, fraud findings, and a declaration of alter ego.
Hogan and Schuelke briefed and won motions securing the dismissal of all but three defendants from the case. The remaining three defendants proceeded to arbitration. After a week-long final hearing and post-hearing briefing, the arbitrator ultimately denied all fraud and alter ego claims and awarded Claimants less than 1% of their requested damages. Claimants have thus far not attempted to have the award confirmed in Court.
