Hogan Thompson LLP Prevails on Eight Summary Judgment Motions for Real Estate Clients
Hogan Thompson LLP partner Chris Hogan secured a major win for several real estate clients in a lawsuit pending in the Southern District of Texas, Houston Division. Working with several of his former colleagues at Reynolds Frizzell LLP, Chris represents numerous affiliates of the Moody National Companies, a prominent real estate firm located in Houston, Texas.
The disputed at issue related to an investment in multiple hotels located in Texas. Investors in the property claim millions of dollars in damages from the Moody National Companies’ affiliates. After discovery and depositions, the parties collectively filed eight summary judgment motions on a variety of claims and defenses such as breach of contract, breach of fiduciary duty, and fraudulent inducement.
Judge Atlas of the Southern District issued two orders on these motions. She ultimately granted all three motions for summary judgment filed by the Moody National Companies’ affiliates and denied all five motions for summary judgment filed by the investors. You can find these orders here and here. Several issues remain outstanding in the case, including the Moody National Companies’ affiliates’ claims for attorneys’ fees based on prevailing on these motions.
